Mark and Leilani Nickerson, a couple from Georgia, have filed a lawsuit against Resorts World Las Vegas for negligence, asserting that their hotel room, a crucial part of their Las Vegas gambling experience, included an unexpected and unwelcome feature: toxic black mold.

The Nickersons lodged their suit on June 2, claiming that their stay at The Conrad on January 23 resulted in severe health issues.
Both individuals reported experiencing headaches, flu-like symptoms, and intense irritation, while Mark developed a full-body rash that he had to seek treatment for at an urgent care facility. These symptoms are consistent with mold exposure, although rashes are often less common.
The lawsuit states, “As a result of exposure to water intrusion, mold, and toxins, the plaintiffs sustained injuries to their bodies and shock to their nervous systems, causing ongoing physical and emotional pain.”
The couple asserts they alerted hotel staff to the situation, who then relocated them to a different room. As they passed their original room, they observed an open door and decided to peek inside.
They found the wall cut open and the carpet pulled back, revealing black mold present everywhere,” they claimed in their complaint.
A maintenance worker confirmed the presence of mold as a result of water intrusion. The Nickersons were informed that such issues were common due to the design of the hotel’s showers.
When the couple requested that Resorts World comp their hotel stay, the hotel declined, instead suggesting they might waive minor fees if they signed a waiver relinquishing all claims against the property.
The Nickersons have declined this offer, and the lawsuit seeks over $15,000 in general and special damages, as well as $15,000 in punitive damages. They also seek reimbursement for their past and future medical expenses, along with any economic losses and attorney fees involved.
There has been no response from Resorts World regarding the lawsuit at this time.
